These Terms & Conditions (“Terms”) govern access to and use of the FansMates platform.

FansMates is operated by AdriSoft s.r.o. (24025054), a company incorporated under the laws of the Czech Republic, with its registered office at Husitská 107/3, Žižkov, 13000 Praha 3 (“FansMates,” “Company,” “we,” “us”).

 

By accessing or using FansMates, you agree to be bound by these Terms.

1. DEFINITIONS

  • Platform – The FansMates website, apps, and services

  • User – Any registered or unregistered visitor

  • Creator – A User who uploads content and earns revenue

  • Content – Any text, image, video, audio, or media uploaded

  • Subscription – A recurring paid access to a Creator’s content

2. ELIGIBILITY

You must:

  • Be at least 18 years old

  • Have legal capacity to enter into this agreement

  • Comply with all applicable laws

Access by minors is strictly prohibited.

3. ACCOUNT REGISTRATION

You agree to:

  • Provide accurate and truthful information

  • Maintain account security

  • Be responsible for all activity under your account

FansMates may suspend or terminate accounts for violations.

4. PLATFORM ROLE

FansMates is a technology and hosting platform only.
We do not create, produce Creator Content.

FansMates verify all creators with identity check of passport / ID / selfie to comply with verification policy. Every creator must be 18+ years old.

5. CONTENT RULES

You may not upload or access content that:

  • Involves minors (real or implied)

  • Is illegal, non-consensual, or exploitative

  • Violates intellectual property or privacy rights

  • Promotes violence, trafficking, or fraud

FansMates reserves the right to remove content at its discretion.

6. CREATOR TERMS

Creators:

  • Retain ownership of their content

  • Grant FansMates a license to host, display, distribute, and promote content

  • Are responsible for all legal compliance, including age verification

Creators represent that all individuals depicted are 18+.

7. PAYMENTS (USERS)

7.1 Paid Services

Users may purchase:

  • Subscriptions

  • Tips

  • Pay-per-view content

  • Other digital services

All prices are shown before purchase.

7.2 Refund Policy

All purchases are final and non-refundable, except where required by law.

Access to digital content begins immediately upon payment, and you expressly waive any statutory right of withdrawal where legally permitted.

 If FansMates is alerted that a Fan has sought and received a Refund or Chargeback, FansMates will take additional actions. Any purchase of the right to view User Content or to use Fan Interaction which is subsequently subject to a Refund or Chargeback may result in the User’s account being immediately and permanently excluded from FansMates. The Refund or Chargeback amount may be removed from the earning Creator's income. The Creator may be alerted to the Fan Refund or Chargeback.

8. PAYMENTS TO CREATORS

8.1 Earnings

Creators earn revenue from user payments, minus:

  • FansMates platform fee

  • Payment processor fees

  • Applicable taxes or chargebacks

8.2 Payouts

  • Payouts are processed via payment providers

  • Minimum payout thresholds may apply

  • FansMates is not responsible for delays caused by processors or banks

8.3 Taxes

Creators are solely responsible for:

  • Income tax

  • Reporting obligations in their jurisdiction

FansMates does not provide tax advice.

9. CHARGEBACKS & PAYMENT DISPUTES

9.1 User Chargebacks

Users agree not to initiate chargebacks for authorized transactions.

Unauthorized chargebacks may result in:

  • Account suspension or termination

  • Loss of access to purchased content

9.2 Chargebacks Affecting Creators

If a chargeback, refund, or reversal occurs:

  • The disputed amount will be deducted from the Creator’s balance

  • Associated chargeback fees may also be deducted

  • FansMates may temporarily withhold payouts to offset risk

9.3 Fraud Prevention

FansMates reserves the right to:

  • Request additional verification

  • Disable monetization for suspicious activity

10. TERMINATION

FansMates may suspend or terminate accounts for:

  • Breach of these Terms

  • Fraud or abuse

  • Legal or regulatory risk

  • Excessive chargebacks

Termination does not affect accrued rights or obligations.

11. DISCLAIMERS

The Platform is provided “as is” and “as available.”

FansMates makes no guarantees regarding:

  • Earnings

  • Content visibility

  • Platform availability

12. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

  • FansMates is not liable for indirect or consequential damages

  • Total liability shall not exceed the amount paid to FansMates in the previous 6 months

13. INDEMNIFICATION

You agree to indemnify FansMates against claims arising from:

  • Your content

  • Your breach of these Terms

  • Your violation of laws or third-party rights

14. DATA PROTECTION (GDPR)

FansMates processes personal data in accordance with:

  • EU General Data Protection Regulation (GDPR)

  • FansMates Privacy Policy

15. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Czech Republic, excluding conflict-of-law rules.

Disputes shall be resolved exclusively by the courts of the Czech Republic, unless mandatory consumer protection laws apply.

16. CHANGES TO TERMS

FansMates may modify these Terms at any time. Continued use constitutes acceptance.
