1. Legal Notice

Pursuant to 18 U.S.C. § 2257 and 28 C.F.R. § 75, all individuals depicted in visual content appearing on the Fansmates platform were 18 years of age or older at the time the content was created.

 

2. Responsibility of Content Creators

Each creator who uploads content to Fansmates is considered the primary producer of their content, as defined under 18 U.S.C. § 2257.

As a primary producer, the creator is solely responsible for:

  • Verifying the age and identity of every individual depicted in their content

  • Maintaining legible copies of government-issued photo identification for all performers

  • Retaining signed model releases or written consent where applicable

  • Ensuring that all content complies with applicable local, state, federal, and international laws

Fansmates does not act as the custodian of USC 2257 records for creator-uploaded content unless explicitly stated otherwise in writing.

 

3. Record-Keeping Requirements

Creators must maintain USC 2257 records in a secure location and make them available for inspection by authorized government officials upon lawful request.

Required records include, but are not limited to:

  • Legal name of each performer

  • Date of birth

  • Copies of valid government-issued photo identification

  • Date of content creation

  • Signed consent or model release (if applicable)

Records must be retained for the period required by law.

 

4. Platform Role (Secondary Producer)

Fansmates operates solely as a hosting and distribution platform for user-generated content and may be considered a secondary producer under USC 2257. As such:

  • Fansmates relies on creator representations regarding compliance

  • Fansmates does not independently verify performer age beyond platform onboarding requirements

  • Fansmates reserves the right to request proof of compliance or remove content/accounts for non-compliance

5. Prohibited Content

Creators may not upload any content that:

  • Depicts or implies individuals under 18

  • Lacks proper age-verification records

  • Violates USC 2257 or related regulations

Violation of these rules may result in content removal, account suspension, termination, and/or referral to authorities.

 

6. Compliance Representation

By uploading content to Fansmates, creators represent and warrant that:

  • All performers are 18 years of age or older

  • All required USC 2257 records exist and are properly maintained

  • They understand and agree to comply with USC 2257 requirements

For USC 2257 record inspection requests related to content on Fansmates, inquiries should be directed to the individual content creator, who serves as the record custodian.

All persons depicted are 18+ at the time of production. Records required by 18 U.S.C. § 2257 are maintained by the content creator.
